Affiliate Agreement

Authorization and Contract

By executing the Alex Ford Affiliate Agreement (“Affiliate Agreement”), you are applying for legal authorization to become an affiliate of Alex Ford, a brand owned and operated by Ford Media Group Pty Ltd (“the Company,” “we,” or “us”), and are entering into a binding contract with the Company. This Agreement outlines the detailed guidelines, responsibilities, and limitations for all affiliates.

The purpose of the Affiliate Program is to provide individuals with the opportunity to promote and earn commissions from our educational products and services. In exchange for generating valid sales or referrals through approved affiliate links, the Company offers compensation according to the terms outlined in the official Affiliate Referral Plan.

Becoming an Affiliate

To become an Affiliate, you must meet the following requirements:

  • Be at least 18 years old (we are unable to pay commissions to anyone under the age of majority in their place of residence);
  • Accept the terms of this Affiliate Agreement by signing up through the official affiliate portal.

Modification of Terms

Because laws and the business environment may change over time, we reserve the right to update or modify this Affiliate Agreement and the Referral Plan at our sole discretion. Notice of any changes will be provided through official communication channels. Updates will take effect thirty (30) days after notification via one or more of the following methods:

  • Posting on the official website
  • Posting inside the official affiliate portal
  • Email notification
  • Other official communication channels

Affiliates are responsible for regularly reviewing any updates. Continued participation in the program after such changes constitutes acceptance of the updated terms.

Term and Termination

This Agreement begins upon our acceptance of your affiliate application and remains in effect until terminated by either party with thirty (30) days’ written notice.

We reserve the right to terminate this Agreement immediately in the event of a material breach. Upon cancellation or termination, you forfeit any rights to commissions, referrals, or other compensation earned through the program.

We also reserve the right to terminate all affiliate agreements with thirty (30) days’ notice if we decide to:

  • Cease business operations,
  • Dissolve the company, or
  • Discontinue affiliate distribution of our products.

Termination of this Agreement does not release either party from any liabilities or obligations that accrued prior to the termination date.

Independent Contractor Status

As an Affiliate, you are an independent contractor—not a purchaser of a franchise or business opportunity. Your success is entirely dependent on your own efforts, strategies, and commitment.

This Agreement does not create an employer/employee relationship, agency, partnership, or joint venture between you and the Company. You are solely responsible for any local, state, federal, or international taxes related to commissions or income earned through this program. You have no authority to bind or represent us in any manner or to make commitments on our behalf.

As a self-employed independent contractor, you are running your own business by promoting and selling our products and services. You may choose your own hours and have full control over how you operate your promotional activities.

For U.S.-based affiliates: if you earn $600 or more in a calendar year, you will be issued an IRS Form 1099-MISC, which you must report to the IRS.

For affiliates outside the U.S.: you are solely responsible for understanding and complying with the tax regulations in your respective country or jurisdiction.

Selling Our Products

You agree not to make any claims, representations, or warranties about our products or services beyond those explicitly provided in our official materials. All marketing and promotional content must reflect the messaging, features, and benefits as outlined by us to ensure accuracy, transparency, and compliance.

Income Disclosure Policy

In alignment with responsible and transparent business practices, we have developed an income disclosure policy to provide accurate, current, and honest information regarding the potential income that affiliates may earn.

This disclosure is intended to help prospective affiliates make informed decisions. A copy of the income disclaimer must be shared with all potential affiliates before enrollment. Please refer to the most recent version of the Income Disclaimer.

Referral Plan

Affiliates must comply with the terms outlined in the official Referral Plan. Affiliates may not encourage or require current or prospective customers or affiliates to engage with the program in any way that deviates from the terms described in official materials.

Affiliates must not request or suggest that others make purchases or payments outside of those explicitly required or recommended in official company documents.

To reduce administrative workload, we reserve the right to delay commission payouts until a cumulative total of $100 or more is reached.

Affiliates are responsible for reviewing their monthly referral statements and must report any discrepancies within thirty (30) days of receipt. After this grace period, requests for adjustments will not be considered.

If you believe there has been an error related to your commissions, bonuses, or charges—or if you have any questions about your compensation—you must notify us in writing within thirty (30) days of the transaction or issue in question.

We are not responsible for any discrepancies, omissions, or concerns not reported within that 30-day window.

Errors or Questions

If you believe an error has occurred regarding commissions, bonuses, or charges, you must notify Alex Ford Support in writing within thirty (30) days of the date the issue first appeared. We are not responsible for any errors, omissions, or discrepancies that are not reported within this 30-day window.

Product Sales

The Alex Ford affiliate program is based on the sale of our products and services to genuine end users. Purchasing products solely to qualify for commissions or rank advance is strictly prohibited.

Bonus Buying Prohibited

Bonus buying is strictly prohibited. This includes, but is not limited to:

  • Enrolling individuals or entities without their knowledge or without a properly executed Affiliate Agreement
  • Fraudulently enrolling someone as an Affiliate or Customer
  • Creating fictitious or “phantom” accounts
  • Purchasing products or services on behalf of someone else, or under someone else’s Affiliate or Customer ID to qualify for commissions or bonuses
  • Buying excessive amounts of products or services that can’t reasonably be used or resold within a month
  • Using any other strategy to artificially qualify for rank advancements, incentives, commissions, or bonuses without genuine end-user purchases

All sales must reflect genuine purchases made by real customers, not generated for the purpose of manipulating compensation.

Returned Product

If a product or service is refunded, any commissions or bonuses previously paid to the Affiliate based on that transaction will be reversed and must be repaid to us. While our products generally include a set refund period, we reserve the right, at our sole discretion, to approve a refund outside of that period when deemed appropriate.

By participating in the Affiliate Program, you agree to this policy and authorize us to recover any commissions or bonuses tied to refunded transactions — even if those refunds fall outside the standard return window.

Pay Period

Affiliates will receive commissions on a monthly Net-30 basis. This means commissions earned this month will be paid on the 30th of the following month, or the next business day if the 30th falls on a weekend or public holiday.

The minimum payout threshold is $100. If your commission balance is below this amount, it will roll over to the next pay period until the threshold is met.

Currently, PayPal is the only supported payout method. We reserve the right to introduce additional payout options in the future, and any changes will be communicated to all affiliates in advance.

Inactive Accounts & Forfeited Commissions

If your account remains inactive for 12 months and your unpaid commissions have not met the $100 minimum payout threshold, those commissions will be forfeited. Inactivity is defined as no referred sales or logins to the affiliate portal during that time.

Use of Sales Aids

While promoting our brand and products, Affiliates must use the official sales aids and marketing materials we provide. If Affiliates choose to create their own sales aids or promotional materials (including websites, social media content, or advertisements), they must first submit them to Customer Support for review and approval.

This policy exists to help Affiliates avoid unintentionally violating advertising regulations or misrepresenting the brand. Unless you receive specific written approval, any submitted materials are considered not approved and may not be used.

Affiliates must also maintain and protect our reputation at all times.

Affiliates may not:

  • Build third-party websites using content copied from official sources without permission.
  • Register or use any of our brand names, product names, slogans, or similar derivatives in domain names, social media handles, or third-party platforms without prior written approval.

Alex Ford Proprietary Information and Trade Secrets

You acknowledge and agree that information we maintain—including databases of prospective and existing customers—constitutes commercially valuable, proprietary business information and trade secrets. This information is confidential and protected.

As an Affiliate, you are granted a personal, non-exclusive, non-transferable, and revocable license to access and use this proprietary information solely for the purpose of promoting your affiliate business during the term of this Agreement.

You may not use this information for any other purpose, including to compete with us or support any competing business. This restriction continues for one (1) year following the termination or expiration of your Affiliate Agreement.

You agree that misuse or unauthorized disclosure of this information could cause serious harm. In such cases, we reserve the right to seek legal remedies, including injunctive relief and/or compensation for damages.

Non-Solicitation

You agree that during your active period as an Affiliate, and for one (1) calendar year following your resignation or termination, you will not directly or indirectly recruit, solicit, or encourage any other Affiliate to join, promote, or engage in a competing business.

Additionally, during this same period, you agree not to solicit or attempt to do business with any customers or companies listed in our customer database for any competing enterprise, unless you can prove a pre-existing relationship that existed prior to entering this Agreement.

This non-solicitation clause will be enforced to the maximum extent permitted under applicable local laws in your jurisdiction. By accepting this Agreement, you agree to honor this provision accordingly.

Constructive Criticism

We are committed to providing our Affiliates with the best possible services, tools, and compensation structure. Constructive feedback is welcomed and encouraged, and should be submitted in writing to Customer Support or directly to our leadership team.

However, public negative or disparaging remarks about the Company that could discourage or undermine other Affiliates may be considered a material breach of this Agreement. Such conduct may result in sanctions, including suspension or termination of affiliate status, as deemed appropriate.

Intellectual Property

Affiliates agree to use our trademarks, copyrighted materials, and branding only in the form and manner provided or approved by us. All promotional materials, logos, and official resources supplied must be used in their original form and may not be altered or modified without prior written consent.

The name “Alex Ford,” the titles of our products and programs, and any related names or marks are proprietary trademarks and service marks owned by Ford Media Group Pty Ltd. These assets are of high value and are provided solely for authorized use in promoting our business and offerings.

Jurisdiction and Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Western Australia, Australia, without regard to its conflict of law principles. Affiliates operating outside of Australia may be subject to additional laws within their own jurisdictions; however, any disputes arising under this Agreement shall be exclusively resolved under the laws of Western Australia.

Contract Submission

A digital or emailed copy of this Agreement shall be considered legally binding and equivalent to an original signed version.

Dispute Resolution

All disputes or claims relating to the Company, its products and services, the rights and obligations of an Affiliate and the Company, or any other matter arising from or relating to this Agreement or any associated terms and conditions shall be resolved exclusively by binding arbitration in Western Australia, or another location as designated by the Company, in accordance with the Commercial Arbitration Act 2012 (WA).

The arbitration will be conducted under rules mutually agreed upon by the parties. If no agreement is reached, the arbitration shall follow the procedures of the Australian Centre for International Commercial Arbitration (ACICA).

For Affiliates located outside of Australia, arbitration proceedings will be conducted in English, and the default location shall remain Western Australia unless both parties agree otherwise in writing.

This agreement to arbitrate shall survive the termination or expiration of this Agreement. Nothing in this clause shall prevent the Company from seeking and obtaining preliminary or permanent injunctive or equitable relief from a court of competent jurisdiction, including but not limited to writs of attachment, garnishment, or injunctions, in order to safeguard its rights and interests before, during, or after the arbitration process.

Indemnification

Affiliates are solely responsible for any verbal or written statements they make regarding our products, services, or compensation, if those statements are not expressly found in official materials. By agreeing to this Affiliate Agreement, you agree to indemnify and hold harmless Alex Ford, Ford Media Group Pty Ltd, and its officers, directors, employees, and agents from any and all liability—whether in the form of judgments, civil penalties, refunds, attorney fees, court costs, or lost business—that arises as a result of your unauthorized representations, actions, or omissions.

This provision will survive the termination or cancellation of this Agreement.

Miscellaneous

If any provision of this Agreement is found to be invalid or unenforceable, that provision shall be modified only to the extent necessary to make it enforceable, and the remainder of the Agreement will remain in full force and effect.

This Agreement may be executed in counterparts, each of which shall be deemed an original, and all of which together shall constitute a single instrument.

This Agreement, including any documents referenced or incorporated herein, represents the entire understanding between you and Alex Ford (operated by Ford Media Group Pty Ltd) and supersedes all prior agreements, representations, or understandings—whether written or oral—relating to your relationship with the Company.

This Agreement is intended to comply with the laws of Western Australia. Affiliates operating in other jurisdictions agree to be bound by this Agreement to the fullest extent permitted by their local laws. If any provision is deemed unenforceable in a specific jurisdiction, it will not affect the enforceability of the remaining terms.
